Summary: Cosmedcomply provides compliance indicators, not legal advice. Our reports are a starting point for review — not a definitive legal determination. Always consult a qualified legal or regulatory professional before making compliance decisions.

1. Not legal advice

The information, reports, scores, findings, and recommendations provided by Cosmedcomply are for general informational and compliance awareness purposes only. Nothing produced by Cosmedcomply constitutes legal advice, regulatory advice, or a legal opinion.

Cosmedcomply is not a law firm and does not provide legal services. No solicitor-client relationship is formed by using our service. If you require legal advice regarding your advertising obligations under the Therapeutic Goods Act 1989 (Cth), the Therapeutic Goods Advertising Code 2021, AHPRA advertising guidelines, or any other legislation, you should engage a qualified Australian legal practitioner with relevant expertise.

2. Compliance indicators, not determinations

Cosmedcomply's scanning framework identifies content patterns that may be inconsistent with TGA and AHPRA advertising requirements. Our findings represent risk indicators based on a structured assessment framework — they are not definitive determinations of compliance or non-compliance.

Whether particular content constitutes a breach of advertising law is ultimately a question of law and fact that can only be determined by a regulator or court. A finding in our report does not mean that a regulator would take enforcement action, and the absence of a finding does not mean that content is lawfully compliant.

3. Framework limitations

Our assessment framework (Framework v3.3) is based on publicly available legislation, regulatory guidance, and documented enforcement activity as at the date of the relevant framework version. It may not reflect:

We update our framework regularly, but we do not warrant that it is complete, current, or free from error at any given time.

4. AI-generated analysis

Cosmedcomply uses artificial intelligence (Anthropic Claude) to analyse webpage content. AI systems can make errors, misinterpret context, or produce incorrect outputs. All AI-generated findings should be reviewed by a qualified person before action is taken. We do not warrant the accuracy, completeness, or reliability of any AI-generated output.

5. No guarantee of regulatory outcome

Using Cosmedcomply and acting on our recommendations does not guarantee that your website will be free from TGA or AHPRA scrutiny, that no enforcement action will be taken, or that your advertising will be found compliant. Regulatory decisions are made by the relevant regulator based on their own assessment processes.

6. Limitation of liability

To the maximum extent permitted by law, Cosmedcomply and its operators exclude all liability for any loss or damage (including consequential loss) arising from reliance on any information, report, score, finding, or recommendation produced by our service. This includes but is not limited to regulatory action, fines, reputational harm, or business interruption.

Our liability is limited to the amount paid for the relevant scan report, to the extent permitted by the Australian Consumer Law.

7. Regulatory framework references

References to legislation and regulatory guidance in our reports are provided for informational purposes. Always verify references against the current, official version of the relevant instrument at the time you are relying on it. Legislation and guidelines change.
